Woman in Her 30s Receives Prison Sentence for Falsely Accusing Father of Rape, Reflecting Tighter Legal Repercussions

In a recent legal case, a woman in her 30s was given a prison sentence after falsely accusing her biological father, who had financially supported her overseas education, of rape because he refused her monetary demands.

Based on reports from the legal sector on the 1st, the Namyangju Branch of the Uijeongbu District Court's Criminal Division 1, led by Presiding Judge Choi Chi-bong, sentenced a woman, referred to as A, to 10 months in prison. She was convicted on charges that include defamation, obstruction of business, and insult.

A was tried for making defamatory statements about her biological father, B, by posting 11 times on an online forum between May and June of the previous year. The posts carried the headline "I am a victim of familial sexual violence. Please look at this."

In the posts, she falsely alleged that "I have been continuously sexually assaulted by my biological father since I was four years old, and my mother also suffered domestic and sexual violence," claiming the issue was resolved with 30 million won in damages and demanding "severe punishment is necessary."

During her posts, A also revealed B's true identity and business details, which reportedly caused him difficulties in managing his business.


 


Moreover, A made six posts falsely asserting that B had remarried a woman, C, with whom he had allegedly had an extramarital affair.

In February 2021, A initiated a lawsuit seeking damages for sexual assault against B at the Incheon District Court, yet failed to provide evidence substantiating her accusations.

Throughout the criminal proceedings, A maintained the truthfulness of her statements, but the court rejected her claims, referencing the lawsuit’s conclusion. According to the court, there was insufficient specific evidence or circumstances to support A's allegations of habitual sexual abuse by B.

The court deemed A's accusations to be false, emphasizing that she had received financial aid from B during her overseas studies and upon returning home. The accusation followed closely after she requested a large sum for a cafe business, which B declined.


The court highlighted, "Her dissatisfaction with being refused financial aid led her to disseminate false information about the victims, severely tarnishing their reputations, which cannot be completely restored."


Further justifying the sentence, the court considered the "high risk of reoffending, as evidenced by her continued similar postings post-crime, alongside the victims' strong calls for severe punishment against her, as decisive factors in the sentencing."
